DOJ says estate agent group can’t protect rules with old deal

Law360 (Aug 11, 2021, 6:23 p.m. EDT) – The US Department of Justice has asked a federal court in Washington to disregard arguments by the National Association of Realtors that an expired settlement shows the agency has approved a rule issued by the trade group that is the subject of an antitrust lawsuit by the technology-driven REX company.

REX-Real Estate Exchange Inc. is suing NAR and Zillow Inc. for changes Zillow made to its website after joining local NAR affiliates and complying with rules that require properties from listing services Multiple Associates, or MLS, are separate from other advertisements.
